In Japan, it has been extremely difficult for employers to try to unilaterally terminate employees.  We will discuss possible and practical risks associate therewith, together with points that judicial judges tend to mention when they handle unilateral termination cases.  Based upon such risks and points, let’s discuss how to mitigate them, with respect to the timing of recruitment and selection.  (Namely, what kind of information employers try to seek for or pay attention to, at the timing of recruitment and selection.)  Further, employees are trying to avoid being hired by atrocious companies these days, and let’s also discuss what employers should do to try to avoid being found to be one of such companies.

2. Risks: (labor union, employment tribunal, official lawsuit) —- on the time and cost to be spent

(B) Recruitment and Hiring Process (paying attention to difficulty in terminating employees)
1. What information employers give weight to in case of recruitment, selection and interview  Entry sheet, resume (CVs), and job history sheet, etc.
2. what employers should do to try to avoid being referred to as a “unscrupulous company ”
3. Probation period
(C) what you should be careful about, on a daily basis from the HR viewpoint
